In order to operate an amateur radio transmitter independently, a person must hold the appropriate amateur radio qualifications. If family members are alone with the equipment, there is no qualified control operator present to oversee the station's operation. While an unqualified person can speak into a microphone if a certified control operator is present and actively controlling the station, they cannot do so alone. Technical knowledge, knowing the right frequencies, or having permission from the station owner does not bypass the strict legal requirement of holding a recognized certificate.
